Overcoming the Complexities in Property Law Transactions

This intensive one day conference walked through a range of property issues covering contractual matters, commercial aspects and regulatory application.
Those in attendance were privileged to hear from Robert Harper SC on Vendor and Purchaser Litigation. Delegates gained insight on the availability and best uses of rescission, termination and repudiation, illustrated by recent case law.
Mark Hilton of Henry Davis York and Jeanette Barbaro, Senior Legal Counsel at National Australia Bank Limited presented a session on Managing the Mortgagor and Mortgagee Relationship, which proved very popular with delegates on account of the pragmatic and entertaining delivery styles of both speakers.
Tony Cahill is an evergreen presenter who didn’t disappoint with his session on Scope and Enforceability of Caveatable Interests. The session explored how practice had been affected since Black v Garnock and what might be practical ways to ensure consistency across the states.
The session on Easements and Covenants was delivered by the delightful Dr Steven Berveling, Barrister. Dr Berveling demonstrated his obvious ease and expertise with his subject and this presentation was very well received.
Another joint presentation was made by Amrit MacIntyre and John Walker, Partners of Baker & McKenzie, on the tax impacts on property matters. Whilst an afternoon session on tax might have challenged some, our presenters ably held the delegates’ attention with what was described as a “very thorough commentary accompanying [a] clear talk”, a commonly held sentiment in relation to this session. Delegates were very interested to hear about the Reliance Carpet and Brady King cases, GST, CGT, stamp duty aspects and more in this seamless presentation.
Debra Townsend, Partner, Mallesons Stephen Jaques was also a very popular presenter, who responded favourably to Ms Townsend’s professional and stimulating expose of the Environmental Planning and Assessment Act issues likely to arise in a property law practice.
At the end of the day, Jeff Lynne of Blake Dawson delivered an insightful discussion on climate change aspects of property law. Jeff distinguished himself with the delegates who uniformly found the topic interesting and a show of his depth of knowledge in this area. Jeff was able to answer a number of interesting queries raised by delegates and some lively discussion ensued.
