Correction

Please note the following changes to Exercise 1, The Parties in a Case, Chapter 2, "Coping with Legal Vocabulary".

Questions
1. Who was defeated in the appeal?
Answer:  Harris.
We know this because:
  1. Harris originally sued Nickerson for his travelling expenses and was 'at first instance' successful.
  2. we are told in line 9 that the decision was appealed and in line 7 the court held that the expenses were not recoverable. Therefore, the original decision in favour of Harris was reversed.
2. Who was the appellant?
Answer:  Nickerson.
We know this because:
  1. the plaintif, Harris, was successful in the first court case;
  2. the appellant launches an appeal. (An unsuccessful party may wish to have the matter reheard in a higher court.)
Nickerson lost the first court case, so s/he would be the appellant.
3. Who was the respondent?
Answer: Harris.
We know this because:
  1. the respondent is responding to the appeal raised against him/her.
  2. Nickerson was appealing, therefore Harris is the respondent.
